We tried to negotiate with the claimant to narrow the scope of the claim, but he did not respond.

That is debatable. Effects of piracy on sales are hard to assess.

I could not tell how many pirated copies of say Pathfinder books are around compared to Paizo's hardcopy and PDF sales. I agree with you, companies are rarely run by complete idiots and so they know, people who turn to piracy in the first place will not suddenly buy products just because their sources dried up. On the other hand, it is equally to tell, how many people buy products because they read a pirated copy. Giving PDFs away for free worked for Eclipse Phase and Posthuman Studios but that does not mean it will work for another Company.

Personally, I think most companies turn a blind eye on piracy as long as they make a decent profit.

Organize a boycott of buying things from Heart of the Deericorn. No more "Fall of Magic", pirated or otherwise. No profit, no company, no cease and desist letters. Of course in this process you are damaging the independent sellers of the hobby we love.... so...

I agree with "No. 120598" though, knowing the effect of piracy on the industry is hard. There are no easy answers.

I have downloaded tons of shit I have never bought... but the operative word there is shit. It was shit, which was why I have never played it or bought it, and it gets deleted as soon as I realize either the system or world content is garbage.

What I can say is I have never played a game of anything from a pirated copy. If the game is good, I want a hard copy of the game in my hands so that I can play it. Shadows of the DemonLord, Fantasy Age, and Cypher all spring to mind as things I bought this year ONLY because I read the pirated copy loved it and bought it.

Big names though like Savage Worlds and D&D 5E, they get no help from piracy as I never think, hey I should check out if D&D is good before I buy it... yeah, never happens. Its D&D, the name says I buy it because inevitably I am going to play it somewhere.

This is absolutely true, with the obvious caveat that you're referring to computer piracy.

Computer piracy involves distributing copies of a work. The originals are untouched, and the owners of those originals still have them to distribute/sell/etc.

Theft involves depriving the owner of the item. If I steal your car, you don't have your car anymore. If I managed to download a copy of your car (I loved that MPAA anti-piracy ad, remember it?) it's not theft - You still have it.

Source: I've been through the court system on larceny charges regarding cars. In more than one jurisdiction.

The author of Fall of Magic has stated on his twitter account, "For the record I only DCMI'd Fall of Magic, not the whole thread. Taking it down was the Admin's decision. As if I had any control over that". I know it's likely he didn't completely follow through with due process to clarify that, but can't this be taken as legal proof, and restore the request thread?

The claimant clearly DMCA'd the entire thread, and sent a second email specifically asking the thread to be removed after we asked him for file URLs instead of the thread URL. He never mentioned Fall of Magic until we removed the thread. We have discussed this with him after a further exchange of emails, and included to him a full timeline of emails, with pictures and SMTP timestamps and IDs. We believe we have settled this matter with him.

As for why the new requests thread is taking so long, we're currently debating rule and policy changes and a guide on how to make proper DMCAs so this shit doesn't happen again. On the one hand, we like the newly vibrant /tg/ community. On the other hand, most of us have jobs and shit now and don't need any additional liabilities sneaking up from behind us.
